Liability Waiver

In agreeing to participate in events at 576 Holly RD Marshfield Ma, I agree as follows:

I fully understand and acknowledge that recreational and fitness activities have

(a) inherent risks, dangers, hazards and such exists in my use of such equipment and my participation in these activities

  (b) My participation in such activities and/or use of such equipment and activities may result in injury or illness including, but not limited to, bodily harm, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability.

  (c) These risks and dangers may be caused by the negligence of the representatives, employees, or volunteers of 576 Holly Rd Marshfield Ma & Yogi Laurens, the negligence of the participants, the negligence of others, accidents, breaches of contract, or other causes.

  (d) By my participation in these activities and for use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or the conduct of the representatives, employees, or volunteers of UYS, or by any other person.

I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify UYS and its representatives, employees, and volunteers from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of any equipment or participation in these activities.

 

Waiver of Liability and Assumption of Risk Agreement Use of Premises Waiver:

 

In consideration of my use of the premises of 576 Holly Rd, Marshfield Ma., I for myself, my heirs, personal representative or assigns, do hereby release, waive, discharge, and covenant not to sue Stephen Drosopoulos, Lauren Folan, & Lauren Ahola, it’s trustees, directors, officers, employees and agents from liability from any and all claims including negligence resulting in personal injury, accidents, or illnesses (including death) and property loss arising from use of premises. Assumption of Risk: Participating at Underground Yoga Society carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I have read the previous paragraphs and I know and understand and appreciate these and other risks are inherent in the activity I am participating in. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. Indemnification and Hold Harmless: I also agree to indemnify and hold harmless Yogi Laurens Inc, Lauren AHola, Lauren Folan,  & Stephen Drosopoulos, its trustees, directors, officers, employees and agents from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of this use of premises.

 

Severability: The undersigned further expressly agrees that the forgoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the law of the State of Massachusetts and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Acknowledgement of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, and fully understand its terms. I acknowledge that I am signing the agreement or clicking yes freely and voluntarily, and intend by my signature or agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law.

 

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING UP FOR ANY EVENT ON THIS SITE, ATTENDING ANY EVENT AT 576 HOLLY RD MARSHFIELD MA, PURCHASING OR DONATING MONEY, SIGNING, OR RESPONDING, I AGREE NOT TO HOLD THE UNDERGROUND YOGA SOCIETY, YOGI LAURENS LLC, STEPHEN DROSOPOULOS, LAUREN AHOLA, AND LAUREN FOLAN LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH, CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. I AGREE I WILL NOT SUE STEPHEN DROSOPOULOS, LAUREN FOLAN, OR LAUREN AHOLA.
